HooYu Terms of Service

These Terms of Service ("Terms") govern your access to and use of HooYu, including its digital keepsake creation tools, photo-based memory cards, stories, dates, places, tags, Shelf, Timeline, card styles, optional AI story polishing, Coins, Apple In-App Purchases, and related features (collectively, the "Service"). By accessing or using HooYu, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required for online services in your jurisdiction if that age is higher. If you are below the age of legal majority where you live, you may use HooYu only with the permission of a parent or legal guardian where required by law.

2. Accounts and Security

Some features may require an account. You agree to provide accurate information, keep it reasonably current, and protect your credentials. You must not impersonate another person, access another account without permission, or bypass account or security controls.

3. Description of HooYu

HooYu may allow you to create a keepsake from a photo; add a title, category, story, date, place, and tags; use optional AI polishing; review, edit, accept, or discard AI-polished text; organize keepsakes on a visual Shelf; revisit them through a Timeline; choose card styles; purchase Coins through Apple's In-App Purchase system; and spend Coins on saving keepsakes or clearly marked digital features.

We may add, modify, restrict, suspend, or discontinue features when reasonably necessary for product, technical, security, legal, or operational reasons.

4. Your Content

"Your Content" means photos, titles, stories, categories, dates, place information, tags, notes, keepsake details, and other material you upload, enter, save, or otherwise make available through HooYu. You retain ownership of rights you have in Your Content.

5. License Needed to Operate the Service

By storing or processing Your Content through HooYu, you grant HooYu a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, resize, format, display, and otherwise handle Your Content only as reasonably necessary to provide, secure, maintain, and improve the Service. This license does not transfer ownership of Your Content to HooYu.

6. Your Responsibilities for Content

You are responsible for Your Content and represent that you have the rights and permissions necessary to use it in HooYu. You must not use HooYu to store or process content that violates law, infringes another person's rights, contains unlawful sexual exploitation, contains malware or malicious code, or is used for fraud, impersonation, harassment, or threats.

7. Photos and Other People's Information

Photos and stories may include other people, personal objects, locations, or private memories. If a keepsake contains another person's image, name, story, or other personal information, you are responsible for respecting that person's rights and obtaining permission where required.

8. AI Story Polishing

HooYu may provide an optional AI feature that refines or rewrites text you choose to submit. You remain in control of the final text and may review, edit, accept, or discard an AI-generated suggestion before saving it.

AI-generated text may contain errors, omissions, unexpected wording, or inaccurate interpretations. You are responsible for reviewing the result before saving or relying on it.

9. Shelf, Timeline, and Card Styles

The Shelf, Timeline, and card-style features are organizational and presentation tools. HooYu does not guarantee that any particular layout, style, order, or visual design will remain available permanently. Some card styles or digital features may require Coins, and the required amount will be shown before you spend them.

10. Coins

HooYu may offer digital Coins for use only inside the Service. Coins may be used for saving keepsakes or accessing clearly marked digital features, card styles, or other eligible items.

• Coins have no cash value.
• Coins are not currency, stored value, or a bank deposit.
• Coins cannot be transferred between users unless HooYu expressly provides that feature.
• Coins cannot be redeemed for cash or physical goods.
• Coin requirements and eligible features are displayed in the app.

11. Apple In-App Purchases

Coin purchases are processed through Apple's In-App Purchase system. Apple may determine the price displayed in your region and may handle billing, payment authorization, taxes, receipts, refunds, and related transaction matters under Apple's applicable terms and policies. HooYu does not receive your full payment card details from Apple.

Available Coin packages, App Store prices, Coin requirements, and eligible digital features may change over time. The current information shown in the app before purchase or spending will apply to that transaction.

12. Refunds and Purchase Issues

Because purchases are made through Apple's In-App Purchase system, refund requests and certain billing disputes may be handled by Apple according to Apple's policies and local law. If a completed purchase is not credited correctly, contact hooyu.support@gmail.com.

13. No Transfer or Cash Redemption

Coins and other digital features are licensed for personal use within HooYu. They do not represent ownership of money or property outside the Service and cannot be sold, exchanged, transferred, or redeemed for cash or physical products unless required by applicable law.

14. Service Availability and Data Preservation

HooYu is not a guaranteed permanent archive or professional backup service. You are responsible for keeping independent copies of photos, stories, or other important information that you do not want to lose. We do not guarantee uninterrupted access, permanent availability of every feature, or recovery of content in every circumstance.

15. Intellectual Property

Except for Your Content, HooYu and its software, interface, visual design, branding, text, graphics, card-style systems, and features are owned by or licensed to HooYu and are protected by applicable intellectual property laws. Subject to these Terms, HooYu grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

16. Prohibited Technical Conduct

You may not interfere with or disrupt the Service, bypass authentication or purchase controls, manipulate Coin balances or payment verification, use unauthorized automated tools to scrape data, introduce malicious software, or reverse engineer the Service except where applicable law expressly permits it.

17. Third-Party Services

HooYu may rely on third-party services for infrastructure, storage, authentication, AI processing, analytics, crash diagnostics, or other technical functions. Apple provides the In-App Purchase system used for Coin purchases. Independent third-party services may be subject to their own terms and privacy practices.

18. Suspension and Termination

You may stop using HooYu at any time. We may restrict, suspend, or terminate access when we reasonably believe you materially or repeatedly violated these Terms, created a security or legal risk, manipulated payments or Coins, or when restriction is reasonably necessary to comply with law.

19. Disclaimers

To the maximum extent permitted by applicable law, HooYu is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, permanent preservation of every keepsake, error-free AI output, or continuous availability of every style, feature, or Coin package.

20. Limitation of Liability

To the maximum extent permitted by applicable law, HooYu and its operators, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, memories, profits, goodwill, or other intangible losses arising from or related to your use of the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded.

21. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless HooYu and its operators from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Service, material breach of these Terms, or content that violates another person's rights. This section does not apply where prohibited by applicable consumer law.

22. Changes to These Terms

We may update these Terms to reflect changes in HooYu, digital features, Coins, legal requirements, safety practices, or business operations. If changes are material, we will provide notice where required by law. Updated Terms will state a new effective date.

23. Governing Rules and Consumer Rights

These Terms are subject to applicable law and mandatory consumer protections. Nothing in these Terms removes rights that cannot legally be waived in your jurisdiction.

24. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
